Terms of Service

1. Acceptance

These Terms govern your use of forgeby.com and the Forgeby platform (formerly known as Alloy) (together, "the Service"). Forgeby is a service of Zmart Com West AB, Swedish organisation number 559019-9161, Gothenburg, Sweden ("Forgeby", "we"). A registered name change to Forgeby AB is in progress; it is the same company either way. By using the Service you agree to these Terms.

2. The Service

Forgeby is a go-to-market platform for tech partners in Europe. Rune, Forgeby's partner development manager (openly an AI), helps partners identify, research and progress co-sell opportunities. Where the seller's own partner cloud is AWS, the library is deepest there; it also reads Azure and Google Cloud where a customer runs them. Rune advises and drafts; he does not act on your behalf. You review and decide before anything is sent or changed.

3. Accounts

Accounts are for organisations that sell IT products or services. We verify a company mailbox at sign-up (a personal mailbox is refused), and we may suspend or close an account that does not, or no longer does, meet this condition. Sign-in is by email. You are responsible for your account credentials and for activity under your account. You must provide accurate information and keep it current.

4. Acceptable use

You agree not to misuse the Service: no unlawful processing of personal data, no infringement of others' rights, no attempts to breach security or exceed authorised access, and no use that violates applicable law or third-party platform terms (including the relevant cloud partner-program terms and the terms of any CRM you connect, such as HubSpot, Lime, Pipedrive, Salesforce, webCRM or OnePageCRM). Access is unmetered under fair use: it covers your own team working your own market. Systematic bulk extraction of the library or contact data, and any resale or redistribution of it, are outside the licence and may lead to suspension under clause 3.

5. Your data and privacy

Our handling of personal data is described in the Privacy Policy. Where we process personal data on your behalf, our Data Processing Agreement applies. You are responsible for having a lawful basis for the data you load into or connect to the Service.

6. AI output

Rune's outputs (drafts, research, estimates) are generated with AI and may contain errors. They are suggestions for your judgement, not professional, legal, or financial advice. Verify before you rely on or send anything. Cost and funding figures are estimates to be validated.

7. Intellectual property

Forgeby retains all rights in the Service, the Forgeby platform and Rune. You retain rights in your own data. You may not copy, resell, or reverse-engineer the Service except as permitted by law.

8. Fees

Forgeby is not open for sale. When it is, commercial terms (including subscription fees and any cloud partner-funding arrangements such as AWS MAP or the Microsoft and Google equivalents) will be published in public and in your written order. If a written order and the published terms differ, the written order prevails for what it covers.

9. Disclaimers and liability

The Service is provided "as is" without warranties to the extent permitted by law. To the maximum extent permitted by law, Forgeby's liability is limited as set out in your agreement. Nothing limits liability that cannot be limited by law.

10. Term and termination

Either party may terminate as set out in the applicable agreement. On termination, we will delete or return your data per the DPA.

11. Governing law

These Terms are governed by the laws of Sweden, with disputes subject to the competent Swedish courts, unless your agreement states otherwise.
